RÈGLEMENT DE LA BOUTIQUE EN LIGNE

    1. Règlement relatif aux conditions générales et au mode de distribution par IKERSHOP.COM SPÓŁKA KOMANDYTOWA avec son siège social à Sanok via la boutique en ligne Omium.eu (ci-après dénommée la « Boutique en ligne »), ainsi que les principes et règles d’utilisation des services électroniques gratuits par IKERSHOP.COM SPÓŁKA KOMANDYTOWA avec son siège social à Sanok.


§ 1 Définitions

    1. Jours ouvrables – désigne les jours de la semaine du lundi au dimanche, qui sont des jours fériés.

    1. Livraison – désigne la vente effective consistant à livrer le Produit au Client, par l’intermédiaire du Fournisseur, de manière au détail dans la commande.

    1. désigne la société de messagerie avec laquelle le vendeur coopère pour la livraison des produits.

    1. Mot de passe – désigne une séquence de caractères littéraires, universels ou autres, sélectionnée par le client lors de l’inscription dans la Boutique en ligne, sécurisée afin de sécuriser l’accès au Compte Client dans la Boutique en ligne.

    1. Client – désignation de l’entité à laquelle s’appliquent le Règlement et la répartition des droits, qui peut être un service électronique ou avec lequel il peut exister un contrat de vente.

    1. Consommateur – une personne désignée qui mène des activités avec un entrepreneur qui ne sont pas directement liées à son entreprise ou qui lui sont accessibles.

    1. Compte client – désigne un panel pour chaque client, lancé en son nom par la vente après que le client se soit enregistré et ait conclu un accord pour la fourniture de services de gestion de compte client.

    1. Entrepreneur – désigne une personne qui est soit disponible, soit une entité organisationnelle n’ayant pas de personnalités caractéristiques, dont l’acte est disponible et qui est disponible, et nous sommes disponibles pour l’utilisateur qui est disponible ou accessible.

    1. Entrepreneur avec droits de consommateur – on entend par là une personne accessible qui a accès à la transmission directement avec son activité commerciale, avec le contenu du contrat de vente, qui n’a pas la nature juridique de cet entrepreneur, avec des commentaires sur l’étendue de son activité commerciale divulgués dans le Registre central et les informations sur l’activité commerciale.

    1. Règlement – désigne le règlement d’application.

    1. Inscription – désigne la mise en œuvre effective selon les modalités d’application du Règlement, requise pour l’utilisation par le Client de tous les utilisateurs de la Boutique en ligne.

    1. Strona Internetowa Sklepu – oznacza strony internetowe, pod którymi Sprzedawca prowadzi Sklep Internetowy, działające w domenie omium.eu.

    1. Produit – oznacza produkt przedstawiony przez Sprzedawcę za pośrednictwem Strony Internetowej Sklepu, mogący być przedmiotem Umowy Sprzedaży.

    1. Trwałość – oznacza zdolność Produktu do zachowania swich funkcji i właściwości podczas normalnego użytkowania.

§ 2 Postanowienia ogólne i korzystanie ze sklepu internetowego

    1. Le Vendeur indique que la désactivation des « cookies » peut entraîner des difficultés ou empêcher l’utilisation du Site Internet de la Boutique.

    1. Pour passer une commande dans la Boutique en Ligne via le Site Internet de la Boutique ou par courrier électronique et pour utiliser les services disponibles sur les Sites Internet de la Boutique, le Client doit disposer d’un compte de messagerie actif.

    1. Il est interdit au Client de fournir du contenu illicite ou d’utiliser la Boutique en Ligne, le Site Internet de la Boutique ou les services gratuits fournis par le Vendeur d’une manière contraire à la loi, aux bonnes mœurs ou qui porte atteinte aux droits personnels de tiers.

    1. Le Vendeur déclare que le caractère public d’Internet et l’utilisation de services fournis par voie électronique peuvent entraîner le risque d’acquisition et de modification des données du Client par des personnes non autorisées. Par conséquent, le Client doit utiliser des mesures techniques appropriées pour minimiser ces risques. Il doit notamment utiliser un logiciel anti-virus et protéger l’identité des utilisateurs d’Internet. Le Vendeur ne demande jamais au Client de fournir son Mot de passe sous quelque forme que ce soit.

    1. It is not allowed to use the resources and functions of the Online Store to conduct business that would harm the interests of the Seller, i.e., advertising another entrepreneur or product; posting content unrelated to the Seller’s business; posting false or misleading content.

§ 3 Registration

    1. To create a Customer Account, the Customer must register for free.

    1. Registration is not required to place an order in the Online Store.

    1. To register, the Customer should complete the registration form provided by the Seller on the Store Website and send the completed form electronically to the Seller by selecting the appropriate function in the registration form. During Registration, the Customer sets an individual Password.

    1. While filling out the registration form, the Customer has the opportunity to read the Regulations and accept its content by marking the appropriate field in the form.

    1. During Registration, the Customer may voluntarily agree to the processing of their personal data for marketing purposes by marking the appropriate field in the registration form. In this case, the Seller clearly informs about the purpose of collecting the Customer’s personal data, as well as the known or anticipated recipients of this data.

    1. The Customer’s consent to the processing of their personal data for marketing purposes is not a condition for the conclusion of an agreement for the provision of the electronic service of maintaining a Customer Account with the Seller. The consent may be withdrawn at any time by submitting a relevant statement to the Seller. The statement may be sent, for example, via email to the Seller’s address.

    1. After submitting the completed registration form, the Customer will receive an email confirmation of the registration from the Seller. At this moment, the agreement for the provision of electronic services for maintaining the Customer Account is concluded, and the Customer gains access to the Customer Account and can make changes to the data provided during Registration.

§ 4 Orders

    1. Information provided on the Store Website does not constitute an offer from the Seller as defined by the Civil Code but only an invitation for Customers to submit offers to enter into a Sales Agreement.

    1. The Customer can place orders in the Online Store via the Store Website or by email, 24 hours a day, 7 days a week.

    1. The Customer placing an order via the Store Website completes the order by selecting the Product they are interested in. Adding a Product to the order is done by selecting the “ADD TO CART” option under the specific Product presented on the Store Website. After completing the entire order and indicating the method of Delivery and payment in the “CART,” the Customer submits the order by sending the order form to the Seller, selecting the “Order and Pay” button on the Store Website. Before sending the order to the Seller, the Customer is informed of the total price for the selected Product and Delivery, as well as all additional costs they are obliged to bear in connection with the Sales Agreement.

    1. The Customer placing an order via email sends it to the email address provided by the Seller on the Store Website. The Customer, in the email sent to the Seller, specifies in particular the name of the Product, color, and quantity from among the Products presented on the Store Website, as well as their contact details.

    1. Upon receiving an email from the Customer as mentioned in §4.4, the Seller sends a return email providing their registration details, the price of the selected Products, available payment methods, and the Delivery method along with its cost, as well as information about any additional payments the Customer would incur under the Sales Agreement. The message also contains information that entering into a Sales Agreement via email entails an obligation to pay for the ordered Product. Based on the information provided by the Seller, the Customer can place the order by sending an email to the Seller indicating the selected payment method and Delivery method.

    1. Submitting the order constitutes the Customer’s offer to the Seller to enter into a Sales Agreement for the Products covered by the order.

    1. After placing the order, the Seller sends a confirmation to the Customer’s email address as soon as possible. Confirmation of the order is the Seller’s statement of accepting the Customer’s offer. Upon receipt of the above email by the Customer, a Sales Agreement is concluded.

    1. After concluding the Sales Agreement, the Seller confirms its terms to the Customer by sending them on a Durable Medium to the Customer’s email address or in writing to the Customer’s specified address during the order placement.

§ 5 Payments

Prices listed on the Store Website next to a given Product are gross prices and do not include information regarding Delivery costs and any other costs that the Customer will be required to incur in connection with the Sales Agreement. The Customer will be informed of these costs when selecting the method of Delivery and placing the order.

The Customer may choose the following payment methods for ordered Products: a) Bank transfer to the Seller’s bank account (in this case, the order will be processed once the Seller sends the Customer a confirmation of the order and the funds are credited to the Seller’s bank account); b) Bank transfer to the Seller’s bank account with the option of personal pickup at the Seller’s office (in this case, the order will be processed immediately after the Seller sends the Customer a confirmation of the order, and the Product will be released at the Seller’s office once the funds are credited to the Seller’s bank account); c) Bank transfer via the external payment system PayPal, operated by PayPal (Europe) S.à r.l. & Cie, S.C.A., based in Luxembourg (in this case, the order will be processed once the Seller sends the Customer a confirmation of the order and receives information from the PayPal system regarding the Customer’s payment); d) Bank transfer via the external payment system tpay.com, operated by Krajowy Integrator Płatności S.A., based in Poznań (in this case, the order will be processed once the Seller sends the Customer a confirmation of the order and receives information from the tpay.com system regarding the Customer’s payment).

The Customer is informed by the Seller on the Store Website about the deadline by which the payment must be made for the order in the amount resulting from the concluded Sales Agreement.

If the Customer fails to make the payment within the time specified in §5 section 3 of the Regulations, the Seller will provide the Customer with an additional deadline for payment and notify the Customer on a Durable Medium. The information regarding the additional deadline for payment will also include a statement that, after the ineffective expiration of this deadline, the Seller will withdraw from the Sales Agreement. If the second deadline for payment expires ineffectively, the Seller will send the Customer a statement of withdrawal from the contract on a Durable Medium, in accordance with Article 491 of the Civil Code.

§ 6 Delivery

The Seller delivers to the territory of the European Union.

The Seller is obligated to deliver Products that are the subject of the Sales Agreement without defects.

The Seller provides information on the Store Website regarding the number of Business Days required for Delivery and order processing.

The Delivery and order processing time indicated on the Store Website is counted in Business Days in accordance with §5 section 2 of the Regulations.

Ordered Products are delivered to the Customer via the Supplier to the address indicated in the order form.

On the day of sending the Product to the Customer (unless the option for personal pickup was selected), the Seller will send a confirmation of the shipment to the Customer’s email address.

The Customer is obliged to inspect the delivered shipment in a timely manner and in accordance with the rules applicable to shipments of this type. In the event of discovering any shortages or damage to the shipment, the Customer has the right to request that the Supplier’s employee draw up an appropriate protocol.

The Customer has the option of personal pickup of the ordered Product. The pickup can be made at the Seller’s office during Business Days, at the hours indicated on the Store Website, after prior arrangement with the Seller via email or by phone.

The Seller, at the Customer’s request, includes either a receipt or a VAT invoice with the shipment that covers the delivered Products.

If the Customer wishes to receive a VAT invoice, they should declare at the time of purchase that they are purchasing the Product as an Entrepreneur (taxpayer). This declaration is made by selecting the appropriate field in the order form before sending the order to the Seller.

In the event of the Customer’s absence at the address provided when placing the order as the Delivery address, the Supplier’s employee will leave a notice or attempt to contact the Customer by phone to arrange a time when the Customer will be present. In the case of the ordered Product being returned to the Online Store by the Supplier, the Seller will contact the Customer via email or phone to arrange a new Delivery date and cost.

§ 7 Warranty for Entrepreneurs

The Seller ensures the delivery of Products free from defects. The Seller is liable to the Entrepreneur if the Product is defective.

If the Product is defective, the Entrepreneur may:

a) Submit a declaration to reduce the price or withdraw from the Sales Agreement unless the Seller immediately and without undue inconvenience to the Entrepreneur replaces the defective Product with a defect-free one or removes the defect. This limitation does not apply if the Product has already been replaced or repaired by the Seller or if the Seller has not fulfilled the obligation to replace the Product with a defect-free one or remove the defect. The Entrepreneur may, instead of the removal of the defect proposed by the Seller, demand the replacement of the Product with a defect-free one, or instead of the replacement of the Product, demand the removal of the defect, unless bringing the item into conformity with the contract in the manner chosen by the Entrepreneur is impossible or would involve excessive costs compared to the method proposed by the Seller. When assessing the excessive costs, the value of the defect-free Product, the type and significance of the defect found, as well as the inconvenience to which the Entrepreneur would be exposed by another method of satisfaction, should be taken into account.

b) Demand the replacement of the defective Product with a defect-free one or the removal of the defect. The Seller is obliged to replace the defective Product with a defect-free one or remove the defect within a reasonable time without undue inconvenience to the Entrepreneur. The Seller may refuse to satisfy the Entrepreneur’s demand if bringing the defective Product into conformity with the Sales Agreement in the manner chosen by the Entrepreneur is impossible or would require excessive costs compared to another possible method of bringing the Product into conformity with the Sales Agreement. The costs of repair or replacement are borne by the Seller.

An Entrepreneur who exercises their rights under the warranty is obliged to deliver the defective item to the Seller’s address. The cost of delivery is covered by the Seller.

The Seller is liable under the warranty if a physical defect is discovered before the lapse of two years from the date of delivery of the Product to the Entrepreneur. The claim for the removal of a defect or replacement of the Product with a defect-free one is time-barred after one year, but this period cannot end before the expiry of the period mentioned in the first sentence. During this period, the Entrepreneur may withdraw from the Sales Agreement or submit a declaration to reduce the price due to a defect in the Product. If the Entrepreneur has demanded the replacement of the Product with a defect-free one or the removal of the defect, the period for withdrawing from the Sales Agreement or submitting a declaration to reduce the price begins with the ineffective expiration of the deadline for replacing the Product or removing the defect.

Any complaints related to the Product or the execution of the Sales Agreement may be directed by the Entrepreneur in writing to the Seller’s address.

The Seller will respond to the complaint regarding the Product or the complaint related to the execution of the Sales Agreement submitted by the Entrepreneur within 14 days of the date of the complaint.

The Entrepreneur may submit a complaint to the Seller in connection with the use of free services provided electronically by the Seller. The complaint may be submitted electronically and sent to the address info@omium.eu. The Entrepreneur should include a description of the problem in the complaint. The Seller will process the complaint immediately but no later than within 14 days and will provide the Entrepreneur with a response.

§ 8 Warranty


Products sold by the Seller may be covered by a warranty granted by the manufacturer of the products or the distributor.
In the case of products covered by a warranty, information regarding the existence and terms of the warranty is always presented on the Store’s Website.

§ 9 Non-conformity of products with the contract


Complaints from Consumers and Entrepreneurs with Consumer Rights

1. A product is considered to be in conformity with the contract if, in particular, the following are consistent with the contract:
a) its description, type, quantity, quality, completeness, and functionality, and for product with digital elements – also compatibility, interoperability, and availability of updates;
b) its suitability for a particular purpose for which it is needed by the Consumer or Entrepreneur with Consumer Rights, which the Consumer or Entrepreneur with Consumer Rights informed the Seller of at the latest at the time of concluding the contract, and which the Seller accepted.

2. Furthermore, to be deemed in conformity with the contract, the products must:

a) be fit for the purposes for which products of that kind are typically used, taking into account applicable laws, technical standards, or good practices;

b) be available in the quantity and have the features, including durability and safety, and for Products with digital elements – also functionality and compatibility, which are typical for the products of this kind and which the Consumer or Entrepreneur with Consumer Rights may reasonably expect, taking into account the nature of the products and public assurances made by the Seller, their legal predecessors, or persons acting on their behalf, especially in advertising or on the label, unless the Seller can demonstrate that:

a. they did not know about the public assurance and could not reasonably have known;

b. before the conclusion of the contract, the public assurance was corrected in a manner and form consistent with the public assurance or in a comparable way;

c. the public assurance did not influence the decision of the Consumer or Entrepreneur with Consumer Rights to enter into the contract.

c) be delivered with packaging, accessories, and instructions that the Consumer or Entrepreneur with Consumer Rights may reasonably expect;

d) be of the same quality as the sample or model that the Seller made available to the Consumer or Entrepreneur with Consumer Rights before concluding the contract, and correspond to the description of such a sample or model.

3. The Seller is not liable for non-conformity of the products with the contract as described in §9 section 2, if the Consumer or Entrepreneur with Consumer Rights was explicitly informed at the latest at the time of concluding the contract that a specific feature of the products deviates from the requirements of conformity with the contract specified in §9 section 2, and explicitly and separately accepted the lack of the specific feature of the product.

4. The Seller is liable for non-conformity of the products with the contract resulting from improper installation of the products if:

a) the installation was carried out by the Seller or under their responsibility;

b) improper installation carried out by the Consumer or Entrepreneur with Consumer Rights resulted from errors in the instructions provided by the business or a third party.

5. The Seller is liable for non-conformity of the products with the contract that existed at the time of delivery and was revealed within two years of that time, unless the shelf life of the products, as specified by the Seller, their legal predecessors, or persons acting on their behalf, is longer. It is presumed that the non-conformity of the products with the contract that became apparent within two years from the time of delivery existed at the time of delivery unless proven otherwise or this presumption is inconsistent with the nature of the product or the nature of the non-conformity.

6. The Seller cannot invoke the expiration of the period for discovering non-conformity of the products with the contract as specified in §9 section 5 if they fraudulently concealed the non-conformity.

7. If the product are non-conforming with the contract, the Consumer or Entrepreneur with Consumer Rights may request repair or replacement of the product.

8. The Seller may offer a replacement when the Consumer or Entrepreneur with Consumer Rights requests repair, or the Seller may offer a repair when the Consumer or Entrepreneur with Consumer Rights requests a replacement, if the chosen method of bringing the product into conformity with the contract is impossible or would entail disproportionate costs for the Seller. If repair and replacement are impossible or would entail disproportionate costs for the Seller, they may refuse to bring the product into conformity with the contract.

9. When assessing the disproportionate costs to the Seller, all circumstances of the case are taken into account, particularly the significance of the non-conformity of the product with the contract, the value of the product in conformity with the contract, and excessive inconvenience for the Consumer or Entrepreneur with Consumer Rights resulting from changing the method of bringing the product into conformity with the contract.

10. The Seller shall carry out the repair or replacement within a reasonable time from the moment the Seller was informed by the Consumer or Entrepreneur with Consumer Rights of the non-conformity with the contract, and without undue inconvenience to the Consumer or Entrepreneur with Consumer Rights, considering the nature of the product and the purpose for which the Consumer or Entrepreneur with Consumer Rights acquired them. The costs of repair or replacement, particularly the costs of postage, transportation, labor, and materials, shall be borne by the Seller.

11. The Consumer or Entrepreneur with Consumer Rights shall make the product available to the Seller for repair or replacement. The Seller shall collect the product from the Consumer or Entrepreneur with Consumer Rights at their own expense.

12. If the product were installed before the non-conformity became apparent, the Seller shall uninstall the product and reinstall them after repair or replacement or arrange for these tasks to be carried out at their own expense.

13. The Consumer or Entrepreneur with Consumer Rights is not required to pay for normal use of the product that were subsequently replaced.

14. If the product are non-conforming with the contract, the Consumer or Entrepreneur with Consumer Rights may declare a price reduction or withdraw from the contract when:

a) the Seller has refused to bring the product into conformity with the contract as per §9 section 8 above;

b) the Seller has not brought the product into conformity with the contract as per §9 sections 10 to 12 above;

c) the non-conformity of the product with the contract persists, despite the Seller’s attempt to bring the product into conformity with the contract;

d) the non-conformity of the product with the contract is significant enough to justify a price reduction or withdrawal from the contract without first resorting to remedies specified in §9 sections 7 to 12 above;

e) it is evident from the Seller’s statement or the circumstances that they will not bring the product into conformity with the contract within a reasonable time or without undue inconvenience to the Consumer or Entrepreneur with Consumer Rights.

15. The Seller is required to respond to the Consumer’s complaint within 14 days from the date of receipt.

16. The Seller shall promptly refund the Consumer or Entrepreneur with Consumer Rights any amounts due as a result of exercising the right to a price reduction, no later than 14 days from the date of receipt of the declaration from the Consumer or Entrepreneur with Consumer Rights regarding the price reduction.

17. The Consumer or Entrepreneur with Consumer Rights may not withdraw from the contract if the non-conformity of the product with the contract is insignificant. It is presumed that the non-conformity of the product with the contract is significant.

18. If the non-conformity with the contract relates only to some of the product delivered under the contract, the Consumer or Entrepreneur with Consumer Rights may withdraw from the contract only in relation to those product, as well as other product purchased together with the non-conforming product, if it is unreasonable to expect the Consumer or Entrepreneur with Consumer Rights to agree to retain only the product that are in conformity with the contract.

19. In the event of withdrawal from the contract, the Consumer or Entrepreneur with Consumer Rights shall promptly return the product to the Seller at their expense. The Seller shall promptly refund the price to the Consumer or Entrepreneur with Consumer Rights, no later than 14 days from the date of receipt of the product or proof of their return.

20. The Seller shall refund the price using the same payment method used by the Consumer or Entrepreneur with Consumer Rights unless the Consumer or Entrepreneur with Consumer Rights has expressly agreed to a different method of refund that does not involve any cost to them.

21. The Seller does not use out-of-court dispute resolution methods mentioned in the Act of September 23, 2016, on out-of-court consumer dispute resolution.

§ 10 Withdrawal from the Sales Agreement

    1. A Customer who is a Consumer or an Entrepreneur with Consumer rights may withdraw from the Sales Agreement within 14 days without providing any reason.

    1. The withdrawal period begins from the moment the Consumer, Entrepreneur with Consumer rights, or a third party indicated by them (other than the carrier) takes possession of the product.

    1. The Consumer or Entrepreneur with Consumer rights may withdraw from the Sales Agreement by submitting a withdrawal statement to the Seller, either in writing to the Seller’s address: IKERSHOP.COM SPÓŁKA KOMANDYTOWA, Plac Św. Michała 3 (38-500), Sanok, or via email at info@omium.eu. The statement can be submitted using the form provided on the Store’s Website under the link: Withdrawal Form. Sending the statement before the deadline is sufficient to meet the withdrawal deadline.

    1. The Consumer or Entrepreneur with Consumer rights may also submit the withdrawal statement via the electronic form available on the Store’s website. Submission of the statement before the deadline is sufficient. The Seller shall promptly confirm the receipt of the statement to the Consumer or Entrepreneur with Consumer rights.

    1. Withdrawal from the Sales Agreement renders it void.

    1. If the Consumer or Entrepreneur with Consumer rights submits the withdrawal statement before the Seller accepts the offer, the offer becomes null and void.

    1. The Seller must refund all payments, including the cost of delivering the product, to the Consumer or Entrepreneur with Consumer rights no later than 14 days from receiving the withdrawal statement. The Seller may withhold the refund until the product are returned or until proof of return is provided, whichever occurs first.

    1. If the Consumer or Entrepreneur with Consumer rights chose a delivery method other than the least expensive standard delivery offered by the Seller, the Seller is not obliged to refund any additional costs incurred.

    1. The Consumer or Entrepreneur with Consumer rights must return the product to the Seller without delay, no later than 14 days from the day of withdrawal. To meet the deadline, sending the product back before the deadline is sufficient.

    1. In the event of withdrawal, the Consumer or Entrepreneur with Consumer rights only bears the direct costs of returning the product.

    1. If the product, due to their nature, cannot be returned by post, the Seller will inform the Consumer or Entrepreneur with Consumer rights of the return costs on the Store’s Website.

    1. The Consumer or Entrepreneur with Consumer rights is liable for any reduction in the value of the product due to handling them in a way that exceeds what is necessary to establish the nature, characteristics, and functioning of the product.

    1. The Seller will refund payments using the same payment method as was used by the Consumer or Entrepreneur with Consumer rights unless they have expressly agreed to another method that does not involve any costs.

    1. The right to withdraw from the Sales Agreement does not apply to a Consumer or Entrepreneur with Consumer rights in relation to agreements where the product are non-prefabricated, made according to the Consumer’s or Entrepreneur’s specifications, or serve to meet their individualized needs.

§ 11 Free Services

    1. The Seller provides the following free electronic services to Customers: a) Newsletter; b) Customer Account Management.

    1. The services mentioned in §11(1) are available 24/7.

    1. The Seller reserves the right to choose and modify the form, time, and method of providing access to the services, and will inform the Customers about such changes in a manner appropriate for changing the Terms and Conditions.

    1. Każdy może zapisać się do Newslettera, wpisując swój adres e-mail w formularzu rejestracyjnym udostępnionym przez Sprzedawcę na Stronie Internetowej Sklepu. Po przesłaniu formularza rejestracyjnego Klient otrzyma niezwłocznie link aktywacyjny e-mailem w celu potwierdzenia subskrypcji. Po aktywacji linku umowa o świadczenie usługi Newslettera zostaje zawarta.

    1. Usługa Newsletter polega na wysyłaniu wiadomości elektronicznych zawierających informacje o nowych produktach lub usługach w ofercie Sprzedawcy. Newsletter wysyłany jest do wszystkich Klientów, którzy dokonali subskrypcji.

    1. Każdy wysłany Newsletter zawiera informacje o nadawcy, pole tematu określające treść wiadomości oraz szczegóły dotyczące rezygnacji z subskrypcji.

    1. Klienci mogą w każdej chwili zrezygnować z subskrypcji Newslettera, korzystając z odnośnika zawartego w każdej wiadomości e-mail lub dezaktywując odpowiednią opcję na swoim Koncie Klienta.

    1. Usługa Konta Klienta jest dostępna po Rejestracji i umożliwia Klientom modyfikację swoich danych rejestracyjnych, śledzenie statusu zamówień i przeglądanie historii zamówień.

    1. Zarejestrowany Klient może zażądać usunięcia swojego Konta Klienta, a Sprzedawca może usunąć konto w ciągu 14 dni od otrzymania żądania.

    1. Sprzedawca może zablokować dostęp do Konta Klienta i bezpłatnych usług, jeśli Klient działa na szkodę Sprzedawcy lub innych Klientów, narusza prawo lub Regulamin, lub ze względów bezpieczeństwa, w tym łamie zabezpieczenia witryny lub angażuje się w hakowanie. Blokada dostępu trwa tak długo, jak jest to konieczne do rozwiązania problemu. Sprzedawca poinformuje Klienta drogą elektroniczną o zablokowaniu konta.

§ 12 Ochrona danych osobowych

    1. Zasady ochrony danych osobowych określa Polityka Prywatności.

§ 13 Rozwiązanie umowy (z wyłączeniem umów sprzedaży)

    1. Zarówno Klient, jak i Sprzedawca mogą rozwiązać umowę o świadczenie usług drogą elektroniczną w każdym czasie i bez podania przyczyn, z zastrzeżeniem zachowania praw nabytych przez drugą stronę przed rozwiązaniem umowy.

    1. Klient, który dokonał rejestracji, może rozwiązać umowę o świadczenie usług drogą elektroniczną poprzez wysłanie Sprzedawcy oświadczenia woli za pomocą dowolnego środka komunikacji na odległość.

    1. Sprzedawca dokonuje rozwiązania umowy o świadczenie usług drogą elektroniczną poprzez wysłanie oświadczenia woli na adres poczty elektronicznej podany podczas Rejestracji.

§ 14 Postanowienia końcowe

    1. Sprzedawca ponosi odpowiedzialność za niewykonanie lub nienależyte wykonanie umowy, lecz w przypadku umów zawieranych z Przedsiębiorcami Sprzedawca ponosi odpowiedzialność tylko za szkodę umyślną w granicach rzeczywiście poniesionej przez Przedsiębiorcę straty.

    1. Treść niniejszego Regulaminu możesz w każdej chwili wydrukować, zapisać na nośniku danych lub pobrać ze Strony Internetowej Sklepu.

    1. W przypadku sporu wynikającego z Umowy Sprzedaży, strony będą dążyć do polubownego rozwiązania sprawy. Prawem właściwym do rozstrzygania wszelkich sporów jest prawo polskie.

    1.
